OPTIONAL EXCURSIONS:
Travel off of and away from the tour vehicle constitutes an optional excursion. Door County Day Trips cannot be held responsible for losses, injuries, or other damages incurred while participating in an optional excursion. This includes damages incurred while visiting a third party location as part of a stop at any kind of business, attraction, scenic stops, or activity. We also can not be held responsible for third party business hours, open days, and policies affecting one’s enjoyment of their services. Top of Page
TOUR MANAGERS:
On our guided daily trips, your driver does a lot more than just drive. They are responsible for your safety and well being, as well as your personal enjoyment of the tour. They alone are the planner, the host, the guide, and the facilitator. For this reason, our driver guides are referred to as Tour Managers because the title is more descriptive of their role in our organization. Top of Page
ITINERARIES:
One of Door County Day Trips main differences is that we customize daily itineraries per the daily group's interests. Because of this, providing exact daily itineraries is not possible. However, we do provide a Basic Itinerary for both our Day and Night Trips which provides a starting point for each. Top of Page
We reserve the right to modify any tour locations and routes we deem necessary to keep the tour running smoothly and efficiently and to account for any unpredictable weather, traffic, or other unforeseen circumstances. If such a modification occurs in regards to locations, we would make every effort to find a suitable substitute and attempt to provide an equivalent or better experience for you. We cannot be held liable for any damages related to these modifications. Top of Page
JOINING A TOUR:
If you purchase a package that includes pick-up, you are responsible for making all necessary arrangements to embark on the trip at the appropriate time at the designated location you provided. Our Tour Manager is likely to call or text you the morning of the tour prior to pick up or when they arrive at the location. You should be ready to step onto the vehicle immediately upon arrival. If you are not readily available upon DCDT arrival, or contact has not been made via phone/text, the manager will continue to attempt contact at the location for up to 5 minutes and then will need to continue on the pick-up schedule without you. If you miss your pick-up, contact us without delay. We will make all reasonable efforts to assist you in making alternate arrangements to join the tour, but you are responsible for any needed transportation to alternate pick-up locations and back to your dwelling. Additionally, no refunds will be issued for unused services. Top of Page
GROUP COMMUNICATION:
By booking with Door County Day Trips you are agreeing to be contacted by the Tour Manager by phone, text, or email (basically anyway they can get ahold of you) in order to arrange pick-up or other travel details. It is not a guarantee that you will be contacted but if the Tour Manager is not certain about your pick-up information, you agree to have them contact you by whatever means they have available. It is also highly likely that your tour manager will call/text you in the morning prior to your pick-up so you can be prepared. In addition, groups may get spread out at times and you agree to allow group texts to be created which may be implemented to accommodate group instructions, meeting locations, and loading times. Top of Page
GROUP PARTICIPATION:
On our group tours, you will generally be traveling with strangers, which can at times be challenging. In order to protect the enjoyment of the experience for the majority of travelers on our trips, we reserve the right to terminate any traveler and/or party member for behavior deemed nonhomogeneous to the rest of the group. Top of Page
IF YOU TERMINATE:
If you decide to terminate your tour with us before final drop-off occurs, please let your Tour Manager know so that we can account for your absence and have you sign a Tour Termination Form. Once you terminate your tour, DCDT cannot be held responsible for your transportation and/or events that happen after our final contact with you. Top of Page
IF WE TERMINATE:
At the sole discretion of Door County Day Trips and/or our Tour Managers, we may ask you to leave the tour. In this case, we will not refund any portion of the package cost, and all expenses incurred by the termination of the day or night trip are your responsibility; including but not limited to acquiring your own transportation back to your drop-off location. Once your tour is terminated, Door County Day Trips is no longer obligated to provide you transportation to any location and your ride privileges will be revoked immediately. Top of Page
RIDERS WITHOUT PRIOR BOOKINGS:
Door County Day Trips is not a taxi service. We cannot pick up, or add additional people or parties mid trip; even if offered compensation. All of our riders must be pre booked according to our insurance policy. Top of Page
AGE REQUIREMENTS:
For most of our tours & packages, you must be 18 or older to make a booking. Travelers under 18 years at the time of travel are considered minors. Minors must be accompanied by an adult 21 years or older. While there is no minimum age, please consider the nature of our trips before bringing very small children. Night Trips require all travelers to be 21 or over. Top of Page
TRAVELERS WITH DISABILITIES OR DIFFICULTIES:
Our vehicles have raised roofs, wide doors, and running boards for easy entry but do not accommodate wheelchairs at this time. We will do everything we can to accommodate any special needs but if you need assistance getting in and out of the vehicle you will need to bring your own assistant who will need to pay as a rider. Service animals will need to have documentation. We cannot guarantee that we will be able to accommodate all special needs. Please contact us prior to making a booking if there are any questions on what we can help you with.
Our itineraries often feature sightseeing and other activities which may involve strenuous activities such as hiking moderate distances, walking up steps or over uneven surfaces. In general, travel conditions in some areas may be more difficult than what you are accustomed to. It is the responsibility of all travelers to consider their own abilities before taking part in any out of vehicle excursions. Top of Page
ACCEPTANCE OF RISK:
You acknowledge that travel, especially to new destinations, may involve some risk to your health and safety and there may be a risk of food poisoning, disease, or injury. By booking with us, you acknowledge that you have considered the potential risks, dangers and challenges, and your own personal capabilities and needs, and you assume responsibility for all such risks. You agree to take all prudent measures in relation to your own safety while traveling, including but not limited to the proper use of safety devices (including seatbelts), and obeying all posted signs and oral or written warnings regarding health and safety. Absent any negligence on our part, Door County Day Trips and our representatives will not be held liable for any claims or causes of action arising from any losses, damages, injuries, or death resulting from failure to comply with safety instructions or warnings or the risks inherent in travel and participating in activities included in our itineraries or otherwise offered by us or our representatives. Top of Page
EMERGENCY MEDICAL TREATMENT:
Should any medical emergency arise which precludes your ability to consent to emergency treatment when such authorization is required, we or our representatives will try to communicate with your travel companions or previously designated emergency contact to request permission for any necessary treatment. If our representatives believe, at their sole discretion, that time or circumstances do not permit such communication, you authorize our representatives to seek on your behalf medical assistance either by calling 911 or by delivering you to local medical facilities. You agree not to hold Door County Day Trips or our representatives responsible for actions or charges relating to any such medical or emergency treatment. Top of Page
BAGGAGE & PERSONAL EFFECTS:
You are responsible for safeguarding your bags, cameras, and other personal effects, including any items purchased while on tour, while in your possession. We are not responsible for lost or stolen personal items, or other personal items that are damaged by other travelers. Should this occur, be sure to let the Tour Manager know so that the incident can be addressed. Top of Page
LOCAL PURCHASES:
We make every effort to give you an opportunity to browse local markets, shops and stores, time permitting. Some itineraries include scheduled stops at specialty stores where you can view a demonstration of a local craft or purchase merchandise. If you decide to purchase these or any other items while on tour, you are responsible for those purchases. We are not responsible for the quality or authenticity of these items. We are not responsible for the delivery or receipt of any item you purchase while traveling, nor can we backtrack on our trip to allow you an opportunity to return an item. Top of Page
LOCAL LAWS:
During travel, you must always comply with the laws and regulations of all places visited. Committing any illegal act may result in your removal from a tour and put you at risk of fines or punishment by local authorities, for which we cannot be held responsible. Top of Page
IMAGES & MARKETING:
While participating in any of our packages, images, photos, or videos may be taken by us, our representatives or contractors, or other participants that may contain or feature you. You consent to any such pictures being taken and grant a perpetual, royalty-free, worldwide, irrevocable license to DCDT, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever without any further obligation or compensation payable to you. Top of Page
DAMAGES & ADDITIONAL CLEANING CHARGES:
In the event you or a member of your group damages the vehicle, soils it excessively, or vomits requiring additional cleaning, expect additional charges on the booking credit card within 48 hours of the tour and up to 7 business days. Cleaning of human waste of any kind by our Tour Manager will earn a $200 surcharge for a sterile cleaning and any damages will be billed based on dealer estimate for replacement or 100% repair of said damaged item. Pictures, witnesses, and or documentation will be available to us for any future litigation and or credit card dispute needs and you will be responsible for any court and legal fees we undertake in order for us to recover our damages. Top of Page
MISCELLANEOUS:
These Terms represent the entire agreement between travelers and Door County Day Trips. There is no additional liability. If any provision of these Terms is so broad as to be unenforceable, such provision will be interpreted to be only so broad as is enforceable. The invalidity or unenforceability of any provision hereof will in no way affect the validity or enforceability of any other provision. Top of Page
These Terms will inure to the benefit of and be binding upon the parties and their respective heirs, legal and personal representatives, executors, estate trustees, successors, and assigns. In the event that some other person or entity seeks compensation for claims from which you have released us from liability by agreeing to these Terms, you (or your estate) will indemnify and hold harmless Door County Day Trips for all sums reasonably incurred in response to such claims, including our reasonable attorney costs and fees.
